Private Bank: assistance in structuring dismissals of private bankers, executives and other categories (in particular, dismissals for “poor performance” related to the unprofitability of the cost of their individual position in relation to fees and commissions generated by their portfolio). Legal assistance to premier banking groups with lawsuits brought by former agents (financial advisors) in relation to the bank’s withdrawal from their contracts, revocation of additional recruitment and/or coordination assignments, resignation for alleged just cause and related claims of the indemnity in lieu of notice, indemnity of termination of contract (pursuant to the applicable collective economic agreement and Art. 1751 of the Italian Civil Code) and bonuses. Legal assistance to an Italian bank with approximately thirty lawsuits (value of claims of over €7 million) concerning claims for damages pursuant to Art. 31 of the Consolidated Finance Act brought by investors, following to a former financial advisor’s Premier Italian private bank:assistance with the acquisition by the third European banking group of seven branches and related private banking business, along with the related employment and commercial agency contracts. Listed British banking group: assistance with labor law issues relating to the sale of private banking business in Italy to an Italian private bank (revision of contracts and management of union relations).
